Is flying over other people's property permitted?

According to § 1 LuftVG, the use of airspace by aircraft is free. Airspace cannot be purchased, rented or leased. It can be used freely as public space. In principle, it is therefore permitted to fly over other people's property. However, there are restrictions for drone pilots due to the operating bans in accordance with the LuftVO, which include residential properties, for example. If you still want to fly over a residential property, you need permission from the respective owner, tenant or leaseholder. The situation becomes more difficult if the property belongs to several parties.
